This request for consultations concerns the countervailing duty measures identified in several items imported from China. These measures were issued by the United States Department of Commerce.
The US side argues that China's state-owned enterprises(SOEs), claimed to be "public bodies", confer countervailable subsidies through their sales of inputs to downstream producers in the absence of sufficient evidence and review. However, China asserts that the "rebuttable presumption" established and applied by the USDOC in respect of whether SOEs can be classified as "public bodies"
