Home > Blossary: Elapse
Elapse, means 'go by', or 'expiration of deadline' for ex. to practice one's legal rights at Court, by proceeding to court trial, thus delay. Date of elapse may not apply, if a doc of notification is submitted to court, thus deadline can be extended, if reasons are duly justified, or case of major force etc. Of couse everything as law provides. This for civil cases, while for penal cases, 'day of elapse' is date of prescription, thus a date, where taking legal action is already outdated for some reasons. This also can have of course Exceptions, for ex. if a murderer is arrested say finally after too many years, and crime has ''been prescribed'' normally by law, but legal results continue to persist, then for any law applying in this case 'for sentence' will be ''transferred to last day before prescription defined by law, for adjudication. For ex. robbery with murder are prescribed, say after 20 years, and murderer is arrested after 23 years. Then 3 years back, for applicable lawsuit and relative adjudication that leads to sentence (and punishment) and upon which date final decision made be court can be by far defined, including all other relative factors...of adjudication For ex. also 'suspension of prescription' can apply upon arrest for ex. of perpetrator,(-s as complices accused of this same crime...) and acceptance of doc of trial/lawsuit by Court, after being formed/redacted and further adjudication. Let's note in this case, that suspension of prescription can also be transferred to future and start''running again'', if in penal cases, claimant does not proceed to relative legal action on time, and just ''moves the time of case to future'' accordingly; For ex. depending on concrete court of jurisdiction, for adjudicating case, and corrsponding date for practicing lawsuit has ''elapsed'.. for say one year, then if this X penal act foresees prescription in 10 years, then time of prescription reaches 21 years totally..
