Home > Blossary: Dispensation
Dispensation, is the process of being discharged of something, of an action, a job position etc. ''His dispensation is due to his incompetency'', thus meaning, that person X has been discharged of his position of official job,-as official-because he/she is unable to fulfill his/her duties. We also have phrase ''Dispensation of Justice''=the Justice was Dispensed'' thus meaning that a Final, actually Irrevocable thus Definite Decision has been made by Court, based on Court Grade and Remedies, thus such decision of final Justice, namely Final Decision is made for ex. by B' Grade Court (Appeal Court) if for ex. a crime is judged at final stage, and an irrevocable decision is made by Appeal Court. Or in case of stage of cancellation, before High (Penal) Court, if decision of Appeal Court, by being submitted for Cancellation to High Court, is actually cancelled, being accepted, we speak of acceptation submission of Cancellation (based on rules mainly of C.C.P as axes and tools of adjudication + Laws of P.C, the criteria based on these axes, through which further search is made on decision of Appeal Court essentially, namely further examination and analysis of content of decision, by means of above axes (axes as tools of C.C.P + rules of P.C), thus if cancellation is 100% accepted or less than 100% up to 60%, then we have case of adjudicated form, in this case, final dispensation of Justice from High Court, if round 60% of content of Appeal of Appeal Court is not accepted, then High Court has produced adjudication, thus final irrevocable decision and Dispensation of Justice. if Appeal is partially accepted or rejected, -rejection up to 40% of essence of content-and 60% accepted, then final dispensation of Justice may not occur, asJudge (Prosecutor) of High Court, assigns in this case, that rest of 40% to be adjudicated again by Appeal Court, actually another court of same grade with other members, Judge of Appeal Court, till an adjudication is reached, and dispensation of Justice is processed this way; If High Court judges, after adjudication of decision of Appeal, and it's content based on above tools of C.C.P and criteria, -as main axes, -of judging, whereas 'horizontal axes'' are rules of C.C.P, thus keys of Trial before High Court, and 'vertical axes are rules corresponding to P.C, being criteria based on these axes, (C.C.P+- rules of P.Code), then a process of final decision, thus Adjudicated form is assigned to Appeal Court, for dispensation of Justice, thus production of Adjudicated, while, if Appeal of Appeal Court, by being checked and analysis, essentially and typically, is rejected 50% and accepted 50% too, then High Court may decide to repeat procedure, of deliberation and deliberate on that 50% of Appeal. In this case for adjudicated of High Court, what is essential is the way, axes, thus rules of C.C.P will be used throughout essential content, for ensuring utility and application of rules of C.C.P, while vertical axes, rules of P.Code, by providing in each case what is foreseen, on basis of use of horizontal axes, thus rules of C.C.P, will ''decide'' how these will be cross-used and how they'll apply throughout main content, in this case, to equalize, balance and match 50% to rest of 50% of content of(previous) decision of Appeal,by interpreting Law, correctly, as Maxim, and adequately/suffiiently, by applying to main content of essence, applicable Laws, in this case, to codes of Penal Procedure, and crossing content to tools, by aligning, typically and essentially on basis of whole above procedure, the previously non matched part of Appeal to content of Application of Cancellation submitted, to be able to respond exactly, concretely and accurately to all parts of request of Cancellation, and thus by making an Irrevocable Decision, produces Adjudicated Form in this case, and Dispensation of Justice. This and much more of course..!!!//
